General Terms & Conditions – Bulk Email Services

1. Acceptance of Terms

By subscribing to or using our bulk email services (marketing or transactional), you agree to these Terms and Conditions. If you do not accept these terms, you may not use the service.

2. Service Overview

We provide high-deliverability infrastructure for sending:

• Marketing Emails: Campaigns, newsletters, product promotions.
• Transactional Emails: Order confirmations, OTPs, alerts, system messages.

Our services include SMTP/API integration, web-based control panels, analytics, and support.

We are committed to full compliance with international email marketing regulations and expect our users to adhere to them.

You must comply with:

You may only send emails to:

• Users who have explicitly opted in (single or double opt-in).
• Users who have an existing business relationship or transaction history.
• Recipients who have been clearly informed of what type of content they will receive.

You must not:

• Use purchased, rented, or scraped email lists.
• Misrepresent your identity, brand, or message.
• Send misleading, deceptive, or illegal content.
• Include viruses, phishing links, or tracking without consent.

Prohibited Use

You may not use our services to:

• Send SPAM or unsolicited bulk emails.
• Use purchased, harvested, or third-party lists.
• Promote misleading, illegal, or unethical content.
• Send phishing, malware, or harmful content.
• Misuse shared IP infrastructure or affect deliverability of others.

Violation will result in:

• Immediate account suspension
• Blacklist reporting
• Legal action as per jurisdiction

Accountability

As a user:

• You are solely responsible for the content and recipients of your email campaigns.
• You must ensure your list complies with consent-based practices.
• You agree to indemnify and hold harmless our company, servers, and affiliates from any claims, losses, or damages arising from your use of the service.

5. ? Anti-Spam & Enforcement Policy

We maintain zero tolerance for spam. Violations include:

• High bounce or spam complaint rates.
• Use of misleading headers or subject lines.
• Sending without consent.

Consequences:

• Immediate account suspension or termination.
• Permanent blacklist from our servers.
• Reporting to international anti-spam authorities (Spamhaus, Spamcop, etc.) or blacklist management sites
• No refund eligibility for terminated accounts.

Due to the real-time allocation of digital infrastructure and deliverability-sensitive IPs:

• All sales are final and non-refundable.
• Setup, panel, or SMTP/IP provisioning are considered consumed once delivered.
• No refunds for account suspension due to compliance violations.

7. ? Performance Disclaimer

While we ensure optimized IPs, domain warm-up, and clean sending protocols:

• Inbox placement, open rates, and conversions are not guaranteed.
• Results depend on list quality, content, sender reputation, and user behavior.

8. ? Data Privacy & Security

• We do not sell or share your email lists or personal data.
• All data is handled per applicable privacy laws (GDPR, IT Act, etc.).
• You retain full ownership of your contact lists and campaign data.

9. ?? Deliverability & Shared Infrastructure

• Marketing senders may be placed on shared IP pools unless a dedicated IP is purchased.
• We reserve the right to throttle or delay delivery in the interest of overall deliverability.
• You are responsible for domain reputation, authentication (SPF, DKIM, DMARC), and bounce handling if using external tools.

10. ? Termination of Service

Your account may be terminated without notice if:

• You violate compliance or anti-spam laws.
• You damage our infrastructure or IP reputation.
• You are inactive for 30+ days (on trial or pay-as-you-go).

11. ?? Recommended Best Practices

• Use double opt-in to ensure consent.
• Include unsubscribe links in every email.
• Use proper sender identity (From Name, Email, Footer).
• Clean your list regularly to remove inactive or bouncing users.
• Authenticate your domain with SPF, DKIM, and DMARC.

12. ?? Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of New Delhi, India or laws in of the respected countries where services are availed. Any legal disputes will be subject to the jurisdiction of the courts of New Delhi, India.

13. ? Amendments

We reserve the right to modify these terms at any time. Continued use after such modifications implies acceptance.
